Mora Business, Owner and Vice President Facing Felony Tax Charges

ST. PAUL, Minn., Sept. 20 /PRNewswire-USNewswire/ -- The Minnesota Department of Revenue announced today that the Kanabec County District Attorney charged BWHC LLC, doing business as Bluewater Yachts, 811 Maple Ave. E., Mora, with one felony count for tax evasion. In addition, the owner and the executive vice president of the business were charged with two felony tax crimes each.

Owner Steven James Klapmeier, 47, of Minnetonka, and Executive Vice President Allen Owen Hagen, 58, of Isle, were charged with failing to collect and remit sales and use tax to the state for five yacht sales. The amount of sales and use tax that should have been remitted totals $168,442.51.

In July 2003, a Minnesota Revenue investigation revealed that a customer had purchased a yacht from Bluewater Yachts for $289,000, and allegedly was not charged sales tax on the purchase. During the investigation, the department discovered that from 2001 through 2005 Bluewater Yachts allegedly conducted a total of five yacht sales ranging in price from $289,000 to more than $687,000 on which no sales tax was collected.

According to the complaint, Hagen allegedly stated that Bluewater Yachts does not collect sales tax on any yacht that is sold. Hagen informed the department that the customers themselves are responsible for paying any sales taxes associated with the purchase of a boat.

Each felony count is punishable by a maximum of five years in prison, a $10,000 fine, or both.

The Minnesota Department of Revenue is dedicated to enforcing tax laws firmly, collecting no more and no less than taxpayers owe. The department takes progressively stricter measures against taxpayers who demonstrate that they will not voluntarily meet their obligations.
